REGULATION OF THE MINISTER OF INDUSTRY

ON
APPOINTMENT OF SURVEYORS TO PERFORM VERIFICATION INTO ACHIEVEMENT OF LOCAL CONTENTS OF DOMESTIC GOODS/SERVICES

THE MINISTER OF INDUSTRY OF THE REPUBLIC OF INDONESIA,

Considering :

• a. that, in the framework of implementation of the provisions of Article 10 paragraph (2) of Regulation of the Minister of Industry No. 11/M-IND/PER/3/2006 on Technical Guidelines for Use of Domestic Products as already amended by Regulation of the Minister of Industry No. 30/M-IND/PER/6/2006, it is necessary to appoint independent government Survey Institutions competent for conducting of domestic goods/services;
• b. that, PT Surveyor Indonesia (Persero) and PT Superintending Company of Indonesia (Persero) have the competence and experience in conducting verification into achievement of local contents of domestic good/services;
• c. that, it is necessary to issues Regulation of the Minister of Industry;

In view of :

• 1. Presidential Decree No. 187/M/2004 on Establishment of United Indonesia Cabinet as already amended several times and latest by Presidential Decree No. 20/P/2005;
• 2. Presidential Regulation No. 9/2005 on Positions, Duties, Functions, Organization Structures, and Work Procedures of the State Ministries of the Republics of Indonesia as already amended by Presidential Regulation No. 62/2005;
• 3. Presidential Regulation No. 10/2005 on Organization Units and Duties of Echelons I of State Ministries of the Republics of Indonesia as already amended latest by Presidential Regulation No. 80/2005;
• 4. Regulation of the Minister of Industry No. 01/M-IND/PER/3/2005 on Organization and Work Procedure of the Ministry of Industry;
• 5. Regulation of the Minister of Industry No. 11/M-IND/PER/3/2006 on Technical Guidelines for Use of Domestic Products as already amended by Regulation of the Minister of Industry No. 30/M-IND/PER/6/2006;

DECIDES :

To Stipulate :

APPOINTING :

• 1. PT. Surveyor Indonesia (Persero)
  Jalan Jend. Gatot Subroto Kav. 56, Jakarta, and
• 2. PT. Superintending Company of Indonesia (Persero)
  Jalan Raya Pasar Minggu Kav. 34, Jakarta

to perform verification into achievement of local contents of domestic goods/services.

SECONDLY :

In performing the verification, the companies, as meant in the FIRST dictum, shall have duties;

• 1. To conduct verification into achievement of local contents of domestic goods/services;
• 2. To contain results of the verification, as meant in paragraph 1, in a report of verification into productions capacity and self-assessment into achievement of local contents; and
• 3. To submit the verification report, as meant in paragraph 2, to the Minister of Industry.

THIRDLY :

In conducting the verification, as meant in the SECOND dictum, the companies, as meant in the FIRST dictum, may collect fee, which amount is stipulated based on agreement of both parties and pursuant to the applicable laws.

FOURTHLY :

The appointment, as meant in the FIRST dictum, does No.invalidate the authority of the Minister of Industry to revoke, replace, and add the number of surveyors to conduct verification into achievement of local contents of domestic good/services.

FIFTHLY :

The companies, as meant in the FIRST dictum, may be also selected by the institutions being users of goods/services to perform verification into achievement of local contents of domestic goods/services.

SIXTHLY :

This Regulation is valid from August 1, 2006

For public cognizance, this Regulation is promulgated by placing it in the State Gazette of the Republic of Indonesia.
